Terms & Conditions

Welcome to US: Our Journey (the "App"). These Terms and Conditions (the "Terms") are a binding agreement between you and Zafiro Labs SAS ("Zafiro Labs", "we", "us" or "our"), a company incorporated under the laws of the Oriental Republic of Uruguay, and govern your access to and use of the App and any related services (collectively, the "Service").

By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract under the laws of your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet these requirements. The Service is not available to users located in China or Russia, or in any other jurisdiction where the Service is prohibited.

2. Your Account

To use most features of the Service you must create an account. You agree to provide accurate and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. Notify us promptly at legal@us-apps.com of any unauthorized access or security incident affecting your account.

3. Pairing With a Partner

The Service is designed for two people in a relationship. By inviting a partner or accepting an invitation, you and your partner acknowledge and agree that:

• Content placed in shared spaces of the App will be visible to each other.
• Either partner may, at any time, unpair the account, after which shared content remains accessible to the partner who created it on their own device, unless deleted.
• Each partner is independently bound by these Terms and is solely responsible for the content they share.
• We are not responsible for disputes between paired partners or for the consequences of content shared between you.

4. License to Use the App

Subject to your compliance with these Terms, Zafiro Labs grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install and use the App on devices you own or control, solely for personal, non-commercial use.

The App is licensed, not sold, to you. We reserve all rights not expressly granted in these Terms.

5. Your Content

You retain ownership of all content you create, upload or share through the App ("Your Content"). You grant Zafiro Labs a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for example, to resize or transcode images), transmit and display Your Content solely as necessary to provide, secure and improve the Service for you and your paired partner.

You represent and warrant that (a) you own or have all rights necessary to grant the above license to Your Content, and (b) Your Content does not violate any law or any third party's rights, including intellectual property and privacy rights.

We may, but are not obligated to, remove or refuse to display Your Content if we reasonably believe it violates these Terms or applicable law.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, harmful or abusive purpose.
• Upload, share or transmit content that is illegal, defamatory, harassing, hateful, threatening, sexually explicit involving minors, or that infringes intellectual property, privacy or other rights of any third party.
• Impersonate any person, misrepresent your identity, or use someone else's account without permission.
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent expressly permitted by mandatory law.
• Probe, scan, or test the vulnerability of any system or network related to the Service, or breach or circumvent any security or authentication measures.
• Use any robot, scraper, automated means or interface not provided by us to access the Service or extract data.
• Use the Service to send unsolicited communications, malware or any harmful code.
• Interfere with or disrupt the integrity or performance of the Service or the data it contains.

7. Subscriptions and In-App Purchases

The Service offers free and paid features. Paid features may be offered as one-time purchases or as recurring subscriptions, in each case processed exclusively through the Apple App Store or Google Play and subject to their respective terms and refund policies.

Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price until you cancel. You can manage and cancel subscriptions at any time in your Apple ID or Google Play account settings; cancelling stops future renewals but does not entitle you to a refund of amounts already charged, except where required by law.

Refunds. Except where required by mandatory law, all purchases are non-refundable. Refund requests must be directed to Apple or Google as applicable.

Changes to plans. We may change subscription prices, billing cycles, or the features included in a plan. Changes will be communicated in advance and will apply only to future billing periods. If you do not accept a price increase, your sole remedy is to cancel the subscription before the change takes effect.

Shared paid features. Where a paid plan unlocks features for both paired partners, the benefits remain associated with the subscribing account. If the subscribing partner cancels or unpairs, paid features may revert to the free tier for the other partner.

8. Advertising

The free tier of the App may display advertising served through third-party ad networks. Subscribing to a paid plan removes advertising from the experiences in which it appears. Your interaction with advertisements is governed by the advertiser's and ad network's own terms and privacy policies.

9. Our Intellectual Property

The Service, including all software, designs, trademarks, logos, text, graphics, sounds and other materials (excluding Your Content), is owned by Zafiro Labs or its licensors and is protected by intellectual property and other laws. Nothing in these Terms grants you any right in our intellectual property other than the limited license set out in Section 4.

You may not copy, modify, distribute, sell, lease, or create derivative works based on the Service, or any portion of it, without our prior written consent.

10. Third-Party Services and App Stores

The Service integrates and depends on third-party services, including the Apple App Store, Google Play, cloud infrastructure providers, analytics providers and advertising networks. Your use of these third-party services may be subject to their own terms. We are not responsible for the practices or content of third parties.

Apple-specific terms. If you obtain the App from the Apple App Store, you acknowledge that these Terms are between you and Zafiro Labs only, and not with Apple. Apple has no obligation to provide maintenance or support for the App, and is not responsible for any product warranties or claims related to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Suspension and Termination

You may close your account at any time within the App (Settings → Delete account) or by contacting legal@us-apps.com. Closing your account signs you out immediately and schedules your data for permanent deletion 30 days later. You can cancel the deletion by signing back in within those 30 days. The full deletion process is described in our Privacy Policy.

We may suspend, restrict or terminate your access to the Service, with or without notice, if we reasonably believe that you have violated these Terms or applicable law, or if necessary to protect the integrity, security or availability of the Service or other users.

Sections that by their nature should survive termination — including Your Content (license already granted to existing data), Our Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law and Disputes and Miscellaneous — will continue to apply.

12. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, statutory or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that the Service will be uninterrupted, timely, secure or error-free; that defects will be corrected; or that the Service is free of viruses or other harmful components.

The Service is intended for personal entertainment and relationship companionship. It is not a substitute for professional medical, psychological, legal or financial advice. Any reliance on content provided through the Service, including any AI-generated suggestions, is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Zafiro Labs, its directors, officers, employees, agents, suppliers or licensors be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenues, data, business or goodwill, arising out of or in connection with the Service or these Terms, whether based on contract, tort (including negligence), strict liability or any other legal theory, and whether or not we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or in connection with the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) USD 100.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, or any mandatory consumer-protection rights you may have under the laws of your country of residence.

14. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Zafiro Labs and its directors, officers, employees and agents from and against any and all claims, damages, liabilities, losses and expenses (including reasonable attorneys' fees) arising out of or in connection with (a) your violation of these Terms or applicable law, (b) Your Content, or (c) your infringement of any third-party right, including any intellectual property or privacy right.

15. Governing Law and Disputes

These Terms and any dispute or claim arising out of or in connection with them or their subject matter are governed by the laws of the Oriental Republic of Uruguay, without regard to its conflict-of-laws principles.

You and Zafiro Labs agree that any dispute arising out of or in connection with these Terms will be submitted to the exclusive jurisdiction of the competent courts of the city of Montevideo, Uruguay, except where mandatory consumer-protection laws of your country of residence grant you the right to bring proceedings in your local courts.

16. Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will notify you within the App and update the "Last updated" date at the top of this page. Changes take effect on the date indicated. Your continued use of the Service after the changes take effect constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and may close your account.

17. Miscellaneous

• Entire agreement. These Terms, together with the Privacy Policy and any additional terms expressly incorporated, constitute the entire agreement between you and Zafiro Labs regarding the Service.
• Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to be enforceable.
• No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of such right or provision.
• Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization or sale of assets.
• Force majeure. We will not be liable for any failure or delay in performing under these Terms to the extent caused by events beyond our reasonable control.
• Notices. We may give notices to you in-app or by email. You agree to receive electronic communications.
• Language. These Terms are drafted in English. Any translation is for convenience only; the English version controls in case of inconsistency.
